Des sueurs froides pour ceux qui craignent que leur projet soit an\u00e9anti par l&rsquo;intervention implacable de la ville. Des incompr\u00e9hensions pour ceux qui ne comprennent pas que la Ville l&rsquo;utilise comme solution magique. Depuis 2021, c&rsquo;est Laurent Amadieu qui le pr\u00e9side.<\/p><p>En quelques mots, il g\u00e8re la dimension fonci\u00e8re de projets d\u2019am\u00e9nagement des collectivit\u00e9s. Il faut ensuite que ces lots soient mis en vente par leur propri\u00e9taires.<\/span><\/p><p>Dans le cadre de la vente, la collectivit\u00e9 est alors consid\u00e9r\u00e9e comme prioritaire.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d442d25 elementor-widget elementor-widget-heading\" data-id=\"d442d25\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Comment ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8bc607e elementor-widget elementor-widget-text-editor\" data-id=\"8bc607e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Par obligation de vendre \u00e0 la collectivit\u00e9.<\/p><p>Une pr\u00e9emption a lieu au moment d&rsquo;une mutation. C&rsquo;est \u00e0 dire lorsqu&rsquo;un propri\u00e9taire vend son bien \u00e0 un autre. La collectivit\u00e9 d\u00e9clenche le m\u00e9canisme et vient se placer au milieu. Le vendeur est alors oblig\u00e9 de vendre \u00e0 la collectivit\u00e9, repr\u00e9sent\u00e9e par l&rsquo;EPFL-D.<\/p><p>Ce m\u00e9canisme est diff\u00e9rent de celui de l&rsquo;expropriation, qui permet par exemple de forcer un propri\u00e9taire \u00e0 vendre tout ou partie de son terrain pour construire une ligne de tram par exemple.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-66f3e13f elementor-widget elementor-widget-heading\" data-id=\"66f3e13f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">EPFL-D ou collectivit\u00e9, qui devient propri\u00e9taire ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-28e36741 elementor-widget elementor-widget-text-editor\" data-id=\"28e36741\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>L&rsquo;EPFL-D est le premier propri\u00e9taire.<\/p><p>La pr\u00e9emption est effectu\u00e9e par l&rsquo;EPFL-D qui devient propri\u00e9taire du bien. On parle alors de \u00ab\u00a0portage EPFL\u00a0\u00bb. Le temps que la collectivit\u00e9 finalise son projet, le bien est s\u00e9curis\u00e9. Le portage peut durer plusieurs ann\u00e9es, par exemple lorsqu&rsquo;il faut attendre que d&rsquo;autres parcelles attenantes soient \u00e9galement pr\u00e9empt\u00e9es ou qu&rsquo;un projet d&rsquo;envergure soit construit.<\/p><p>Les biens ne sont pas mis en friche pendant ce temps. C&rsquo;est le r\u00f4le de l&rsquo;EPFL-D de les faire vivre. Par exemple en le louant ou en l&rsquo;utilisant comme solution temporaire.<\/p><p>Lorsque la collectivit\u00e9 a finalis\u00e9 sont projet, elle rach\u00e8te le terrain \u00e0 l&rsquo;EPFL-D qui ajoute au co\u00fbt du terrain les frais de portage, minimis\u00e9s si elle a r\u00e9ussi \u00e0 valoriser le bien pendant le portage.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41fe1b2 elementor-widget elementor-widget-heading\" data-id=\"41fe1b2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Pourquoi ne pas l'utiliser plus souvent pour bloquer les projets immobiliers ?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-15ccc08 elementor-widget elementor-widget-text-editor\" data-id=\"15ccc08\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Parce que la Justice fait son boulot<\/p>\n<p>En effet, une pr\u00e9emption est prononc\u00e9e par un juge. Elle doit alors \u00eatre argument\u00e9e et surtout justifi\u00e9e. A la collectivit\u00e9 de d\u00e9montrer le pr\u00e9\u00e9minence de l&rsquo;int\u00e9r\u00eat public sur l&rsquo;int\u00e9r\u00eat particulier. Convaincre un juge de contourner la loi n&rsquo;est pas l&rsquo;exercice le plus simple.<\/p><p>Il faut \u00e9galement convaincre l&rsquo;EPFL-D de la viabilit\u00e9 de l&rsquo;op\u00e9ration. C&rsquo;est lui qui va devenir propri\u00e9taire du bien et qui devra le g\u00e9rer le temps du projet. Le dossier doit \u00e9galement \u00eatre convaincant.<\/p><p>Enfin, la collectivit\u00e9 doit aussi bien ma\u00eetriser les cons\u00e9quences de ce dispositif et anticiper les besoins \u00e0 moyen et long terme.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Qui peux pr\u00e9empter ?
